Dear Mr. Ca restia:
We have reason to believe that your operation may currently be in violation of
your Colorado tdined Land Reclamation Permit. You are strongly advised to
consider the information herein, and respond prompt y. ai ure to o so will
result in action by the Mined Land Reclamation Board, and such action may lead
to civil penalties.
1. The Division's inspection of 2/26/91 noted a problem with records and
processing facilities. The asphalt (hot mix) plant which now lies on the
property is not addressed in the original permit. You were instructed in
the inspection report to submit a Technical Revision to the Division by
April 26, 1991, describing the plant and the location of the plant in the
pit. We have not received a technical revision.
2. The Division's inspection of 2/26/91 also noted a problem with financial
warranty. You were instructed in the inspection report to add E2500 in
financial warranty by August 26, 1991, or convert your operation to a 112
permit and submit the additional financial warranty with the conversion
application. We have not received the additional financial warranty nor
the 112 Conversion Application.
Page 2 of the inspection report notes: "The possible violations should be
corrected by the dates given, or they will become possible violations."
Please know that "possible violations" differ from "problems" in that problems
arc' addressed by the t4ined Land Reclamation Division whereas "possible
violations" are addressed by the Mined Land Reclamation Board. The "possible
violations" are potentially more serious because they require the board to
consider civil penalty. By failing to respond to the noted problems by the
dates given in the inspection report, we have reason to believe that you are
in violation of the conditions of your reclamation permit.
