If <br />this information is sufficient, please allow this issue to qo ' <br />before the Board during their January meeting. <br />On a related issue with this permit; the operator will agree to a <br />r_ondition being placed on the permit to prevent him from mining <br />closer than 200 feet to any man-made permanent structure, unless <br />there is an agreement between the owner and the operator allowing <br />the mining to occur within the 200 foot setback. Such an agreement <br />will be submitted to the Division prior to active mining within the <br />200 foot setback. <br />Please let us know if this agreement is acceptable and if this <br />permit will be brought before the Board this month.
