A formal status change has never been requested <br />by Sunnyside Gold Corporation (SGC) and DMG has not notified SGC of <br />any status change based on activities at the site. The five-year <br />temporary cessation period allowed without extension expires on <br />August 17, 1996. <br />The recently negotiated Consent Decree contemplated a series of <br />projects while treatment operations at the American Tunnel <br />continue. Final reclamation of that site and Tailing; Pond #4 <br />cannot occur until permit release is achieved under the Consent <br />Decree, which may take more than five years. There~Eore, SGC <br />requests an extension of its temporary cessation status for an <br />additional five years. <br />If this is not appropriate for the site activity, then SGC requests <br />final reclamation status effective August 17, 1996. If final <br />reclamation status is found to be more appropriate, SGC' wants to <br />clarify that previous time schedules for final reclamation no <br />longer apply. Further site reclamation beyond that already <br />accomplished will be delayed until successful completion of SGC's <br />Consent Decree commitments thereby allowing SGC to proce~ad towards <br />final reclamation. <br />~~ <br />
