<br />RF~E~~ED <br />BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />Divisio JUN 2 j 1998 <br />~ otMiner~y ~ ~eolo9Y <br />AMERICAN SODA BRIEFING PAPER <br />ADDRESSING THE ALLEGED REQUIREMENT OF WATER QUALITY BASELINE DATA <br />IN THE MATTER OF AMERICAN SODA, L.L.P., YANKEE GULCH MINERALS PROJECT, <br />FILE No. M-99-002, APPROVAL OF A 112 PERMIT AMENDMENT APPLICATION <br />BACKGROUND <br />Prior to American Soda, LLP's ("American Soda") filing of a Regular Operation (§ <br />112) Reclamation Permit Application for the Yankee Gulch Sodium Minerals Project (the <br />"Application') on January 20, 1999, American Soda, acting through Steigers Corporation <br />met with the staff of the Minerals and Geology Division of the Division of Natural <br />Resources for the State of Colorado ("DMG"). <br />At that meeting, it was determined by American Soda and DMG that the mining <br />enterprise (the "Mine") proposed by American Soda did notconstitute a Designated Mining <br />Operation ("DMO") as envisioned by Colorado Statute and Colorado Hard Rock/Metal <br />Mining Rules and Regulations. Subsequent to the filing of the Application, DMG <br />determined the Mine did fall within the definition of a DMO and so advised American <br />Soda. <br />As a result of this changed designation and as a part of the continuing process of the <br />approval of the Application, DMG determined thatadditional water quality data should be <br />developed by American Soda pursuant to its Groundwater and Surface Water Monitoring <br />Plan (the "Plan'). DMG actively participated in American Soda's development of the Plan <br />for the Mine which Plan has now been formally approved by DMG, the Bureau of Land <br />Management, the County Commissioners of Rio Blanco County, Colorado and informally <br />approved by the Environmental Protection Agency. <br />AMERICAN SODA -1- BRIEFING PAPER <br />
