. ~,_ <br />Diamond Lacy L Ranch Enterprises, LLC O and Delta County <br />Access and Water Pipeline Agreement <br />will not be shazed at any time with County Operations. After initial construction, County will not <br />maintain said access roads. <br />2.2 Count Grant, road rghts of wav: Upon completion of mining operations, two or more road rights of <br />way of at least 60 feet in width shall be designated across County Lands to connect from G Road to <br />pazcels located north of County Lands including the land belonging to Diamond Lazy L Ranch <br />Enterprises, LLC. <br />2.3 County Grant, waterline: After completion of mining, the water line will be replaced with like <br />materials in size, condition and location as close to original as practical. The water line will not be <br />changed in size or length from that as it presently exists. If Ranch requests, County will replace the <br />concrete pad originally installed for placement of a stockwater tank. If requested to be replaced, the <br />concrete pad will be replaced as near as practical to its present location. <br />2.4 County Grant. waterline easement: County will grant an easement for a water line along or neaz the <br />west line of the SEI/4SE1/4 of Section I5, T(SS, R95W, 6PM, in a location that is approximately the <br />same as existed prior to mining, with the exception that the easement shall extend to the north line of <br />the SEI/4SE1/4 of Section 15, TISS, R95W, 6PM. The easement will be 30 feet in width. <br />2.5 Ranch Grant access: Ranch agrees and understands that said County Lands am for the purpose of an <br />active gravel mining operation; that said lands will be fenced with locked gates; that Ranch shall be <br />permitted to furnish a lock or locks for its exclusive use; that said access roads will be relocated from <br />time to time to accommodate gravel mining operations. <br />2.6 Ranch Grant. mittine onerations: Ranch agrees that if Ranch conducts gravel mining operations on <br />Ranch properties it will conduct such operations to not interfere with County gravel mining operations; <br />that tracks hauling Ranch gravel will use roads and gates across County Lands that are sepazate from <br />County used roads and gates; [ha[ Ranch will maintain those roads it uses;~that any required signs for <br />Ranch operations will be at different locations than County signs; that such roads, gates, signs, etc., <br />may have to be changed to accommodate County mining operations so the two operations aze not <br />confused as a single operation. County gravel is not to be used to benefit private patties. <br />2.7 Ranch Grant, water line: Ranch agrees that the waterline will be destroyed by gravel mining and that it <br />will not be replaced or functional until after mining has progressed easterly to a point the waterline can <br />be replaced. Ranch agrees that replacement of the waterline will be with materials of like size, <br />material and length as exists prior to gravel mining operations. <br />2.8 Ranch Grant. laie and fence. Diamond Lazy L Ranch Enterprises will respect the gate and fence and <br />will attempt to maintain security of the area by closing and locking the gate after use. <br />2.9 Ranch Grant, use of County Prooertv. Diamond Lazy L Ranch Enterprises win no[ park vehicles or <br />other materials on County property, or use County Property in any manner. <br />2.10 Term: The tertrt of this Agreement shall commence on the date signed and shall remain in effect until <br />County has completed mining and reclamation of the County Lands, and has established road rights of <br />way and a waterline easement as described above at which time this agreement shall terminate. <br />3 MISCELLANEOUS <br />3.1 Permits The County shall be responsible for obtaining from the appropriate governmental agencies all <br />permits necessary for County gravel mining operations contemplated under this Agreement. <br />M:\Engineering\gravel pits\GravelPitGeneral\Whiting\stroud\StroudContractFINAL.doc <br />Page 2 of 5 <br />
