Documentation of the agreement with adjacent landowner to the north (Clinton Stroud dba Diamond <br />Lazy L Ranch Enterprises) to extend existing stock water line is enclosed. <br />2. Delta County will cleazly mark the boundaries of the small triangle of land between Phasel and Phase 2 <br />so that no disturbance will occur in this azea. All other boundaries will be cleazly marked if not already <br />delineated by fence lines. <br />3. We agree that the 20 day requirement past the last date of publication puts the end of the comment <br />period at June 12, 2007. This discrepancy azose because the first publication of nofice appeared in the <br />local paper one day before official notice to proceed was received and I added an additional week of <br />publication but neglected to change the 20 day comment date in the notice. Notice was actually <br />published five consecutive weeks. <br />4. Delta County will clean up any reject and over spill asphalt at the site at least once a quarter and <br />stockpile it neaz the asphalt plant site to be recycled with the recycled asphalt product. <br />S, Damage agreements for Mikal Stroud, Clinton Stroud and Diamond Lazy L Ranch Enterprises are <br />enclosed with this response. The only damage agreement not yet obtained is with Roger Christian. <br />Delta County commits to staying at least 200 feet away from any fences of Mr. Christian until. that <br />agreement is obtained and copies are delivered to DRMS staff <br />6. Under no circumstances will any slope created by this operation be steeper than 2:1 after reclamation is <br />complete.. <br />Please let me know if there is any additional information that you need.
