The <br />Grantee shall be responsible for construction, upkeep and maintenance of the road <br />within the Easement Property during the term of the Easement. <br />2. TERM OF EASEMENT: RECLAMATION. This Easement shall terminate on <br />the eazlier of (1) twenty yaars frplrf the.date of.racordi~g of this Easerrfetpt~lf` (2~+ <br />c"omplGtion o#4he gravel operations and reclamation o the Gravel httiriln3 <br />PralTei•ty in accordance with the I7MG Permit; aid tortriination of the DMG <br />permit and release of the Grantee ttom the conditions df the ISMG Permit. <br />Grantee shall notify Grantor in writing at least thirty (30) days in advance of the <br />anticipated termination of the DMG Permit. Prior to termination of this <br />Easement, Grantee shall reclaim the road by grading it to natural contours, <br />planting the reclaimed area in native grasses approved by the Crrantor, and <br />completing all other requirements of the DMG Permit for reclamation of the road. <br />At the time of Termination of this Easement Grantee shall quit claim to Grantor, or <br />to its successors in interest, all interest oC the Grantee in the Easement Property <br />based upon this L•asement. <br />3. LIABILITY; INSURANCE. Grantee shall hold harmless, indemnify, and defend <br />the Grantor from and against all liabilities, penalties, costs, losses, damages, <br />expenses, causes of action, claims, demands, or judgments, including, without <br />limitation, reasonable attorneys' fees, arising from or in any w•ay connected with <br />injury to or the death of any person, or physical damage to any property, resulting <br />from arty act, omission, condition, or outer matter related to Grantee's use of the <br />Easement Property. Grantee shall maintain general liability insurance for its use <br />of the Easement property in art amount approved by the Grantor, in its reasonable <br />discretion, and shall cause Grantor to be named as an additional insured on such <br />policy. Grantee shall provide a copy of such insurance or certificate of such <br />insurance to Grantor at the time this Easement is executed and at other times upon <br />the request of Grantor. <br />4. ,SUCCESSORS. The covenants, terms, conditions, and restrictions of this <br />/ '~ Easement shall be binding upon, and inure to the benefit of, the parties hereto and <br />CGM- their successors and assigns. The term Grantor shalt include rite original grantor, <br />and the successors and assigns of the original grantor.
