This <br />information is also included in the Notice of Intent to Explore <br />document X-2005-212-006. <br />2.03.7 RELATIONSHIP TO AREAS DESIGNATED UNSUITABLE FOR <br />MINING <br />(1) Each applicant shall contain a statement of available information on <br />whether the proposed permit area is within an area designated unsuitable <br />for surface coal mining operations under Rule 7 of these Rules or 30 CFR <br />764 and 769 or under study for designation in an administrative <br />proceeding under Rule 7 or 30 CFR 764 and 769. <br />The proposed project area is not within an area designated unsuitable <br />for coal mining operations. <br />(2) If an applicant claims that the proposed permit area should not be <br />included within the area designated, or under study for designation, as <br />unsuitable for surface coal mining operations because he or she has made <br />substantial legal and financial commitments, in relation to the operation <br />for which he or she is applying for a permit, prior to January 4, 1977, the <br />application shall contain information supporting such an assertion. <br />No occupied dwellings exist within 300 feet of the MCC, LLC surface <br />operations. (See Map 1) <br />2.03.8 PERMIT TERMINFORMATION <br />(2) Each application for underground mining activities shall state the <br />anticipated or actual starting and termination date of each phase of the <br />underground mining activities and the anticipated number of acres of <br />surface land to be affected, and the horizontal and vertical extent of <br />proposed underground mine workings, for each phase of mining and over <br />the total life of the permit. <br />The current 5-year permit area is shown on Map 1. The permit term <br />is for 5 years. <br />Activities in support of exploration drilling and mine related fire <br />suppression activities at the laydown and storage area are scheduled <br />for January 20, 2006. It is anticipated that the area will be in use for <br />approximately 5 years. The size of the laydown pad, storage area, and <br />road right-of-way will be approximately 1.48 acres <br />3 <br />
