Berry, III <br />Department of Natural Resources <br />Mined Land Reclamation Division <br />1313 Sherman Street <br />Denver, CO 80202 <br />Dear Mr. Berry: <br />The purpose of this letter is to formally request that the <br />content of the public hearing scheduled for May 28, 1980, <br />to consider Colony Development Operation's Regular (112) <br />mining application permit be'slightly changed. <br />The change we request is that this hearing consider only <br />those sections of the application pertaining to the access <br />road and mine bench work to be done during the summer of <br />1980. If this request is granted, t'nen it would be our <br />understanding that an approval by the board at this time <br />would be for the access road and mine bench only. <br />We would ask approval by the staff and board for the rest <br />of the mining and reclamation permit in June or July when <br />the questions posed by the MLP, staff regarding the mine, <br />processed shale pile and process plant, etc. have been <br />answered. <br />The complex of reasons for requesting this partial approval <br />include the economics of a $1.7 billion project with an <br />anticipated 52-month-plus construction schedule, tl~e re- <br />strictions of construction during inclement weather and <br />problems associated with honoring commitments to other per- <br />mits already obtained. <br />We understand that the board's approval of the road and mine <br />bench activity will not affect the processing or outcome of <br />the total application in any manner. We will provide a bond <br />for the reclamation work associated with the road and mine <br />bench construction work to be completed this year. vle also <br />agree Chat should the Colony project, as described in the <br />comp let:e application, not proceed on a continuous and in an <br />expeditious manner, the reclamation activities presented in <br />the application will be completed for the road and mine bench. <br />
