Colorado 80487-8801 <br />(970)870-8773 <br />Faz (970) 870-9006 <br />RFr.FIVED <br />MAY 31 1996 <br />Division of ivtuierals a ~eoiogy <br />Enclosed for your files is a signed original of the Acceptance Of Notice Of Intent To Conduct <br />Coal Exploration No. X-96-219-00, with attached Stipulations No. I-6, issued to the Cottonwood <br />Land Company. <br />Also enclosed for your review is the documentation for Stipulation No. 4 involving the State of <br />Colorado, which owns surface on PDH-2 and 3 and coal on PDH-2,3,5,12,and 18. Please note <br />that although Stipulation No.4 mentions a "State lease" as a requirement, Cottonwood Land <br />Company has been issued Exploration Permit No. 2575 by the Colorado State Land Board, <br />effective for the period April 11, 1996 to September 30, 1997, and covers the exploration to be <br />conducted under N.O.I. No. X-96-219-00. We are presently negotiating with the Land Board for <br />a Coal Lease which would supersede the Exploration Permit and cover the period from <br />September 30, 1997 to the end of the term of this N.O.I.(June 30, 1998) and beyond. <br />In addition, to satisfy the landowner agreement requirement for Stipulation No.4, enclosed are <br />copies of Memorandum of Surface Use Agreements covering Earle surface on PDH-1 and 12, <br />Earle private coal on PDH-l and Camilletti surface on PDH-18. The Cottonwood Land <br />Company owns the surface on PDH-5 so no agreement is required.. <br />We are presently negotiating surface agreements with the owners of the sites in Stipulation No.S <br />and 6 and will forward you copies as soon as they are obtained. Of course, in the event surface <br />owner agreements cannot be obtained for any particular site we will seek to change the location <br />or abandon drilling that particular PDH location.
