On August 10, 2001 the Division received a letter from the City of Rifle rescinding all previous
comments/objections and withdrawing as a party to the Mamm Creek Reclamation Permit
Application.
Since the City of Rifle was the only objector to this application, there is no longer a need or
statutory requirement to hold aPre-hearing Conference or Mined Lnnd Reclomotion Board
hearing for this application. Therefore, these two meetings, announced in the Division's previous
letter to you, will not be held.
As a result of this withdrawal, the decision on the application will be made at the Division Staff
level.
The Division requests that the applicant respond to all previous ndequnry review questions by
August 20, 2001, in order to give the Division adequate time to review the responses.
The applicant may request on additional waiver to their right to a decision up to the 365"' day
from the date the application was received by the Division. This final date is September 19,
2001.
If the opplicant wishes to request a decision date after September 19, 2001, the request for a
decision extension must be made to the Board during its September 19-20, 2001 meeting.
