<br />EXHIBIT G <br />Source of Legal Right to Enter <br />(Section 6.3.7) <br />Access to Browo Derby Mine <br />Access to the Brown Derby Mine is across an existing mine access road heading east from <br />Highway 162, north of the Indian Head landmark. This road is approximately two miles long, <br />and is shown on the Location Map accompanying Exhibit A -Legal Description and Location <br />Map. The road was built with public funds by the United States Forest Service in 1944 <br />specifically for the purpose of accessing the Brown Derby Mine, and has been in continuous use <br />since. Applicant has located the following documents evidencing construction of the road <br />specifically for this purpose: <br />1. "Form No. PR-DA-1," dated December 18, 1943, completed by John W. Spencer, <br />Regional Forester, U.S. Forest Service, and recommended by the Acting District Engineer, U.S. <br />Bureau of Mines, on February 5, 1944, evidencing the initial request for authorization of <br />construction of the Brown Derby Mine access road. <br />2. Letter dated April 7, 1944, from B.W. Matteson, District Engineer, Public Roads <br />Administration, to John W. Spencer, Regional Forester, U.S. Forest Service, evidencing <br />certification of construction of the Brown Derby Mine access road by the War Production Board <br />on April 4, 1944. <br />3. "Access Road Report," undated, evidencing completion of construction of the <br />Brown Derby Mine Access Road on June 24, 1944, at an actual construction cost of $8,338.03. <br />4. "War Minerals Report of the United States Department of the Interior-Bureau of <br />Mines; Brown Derby Mine," dated May, 1945, evidencing Bureau of Mines approval of and the <br />subsequent construction of the mine access road. (See, p. 3} <br />These documents are included in this Exhibit G. <br />Brown Derby #4 Unpatented Lode Mining Claim <br />Applicant owns the Brown Derby #4 unpa[ented lode mining claim, within which [he affected <br />lands lie, subject to the pazamount title of the United States of America. Applicant's right of <br />entry upon the surface, and its rights in and to the minerals within the Brown Derby #4, derive <br />from the General Mining Law of 1872 and the relevatrt mining laws of the State of Colorado. <br />The Brown Derby #4 is identified by U.S. Bureau of Land Management Colorado Mining Claim <br />Serial No. 250337. Applicant acquired the Brown Derby #4 from its locators by Quitclaim Deed <br />dated August 2, 1999, a photocopy of which is attached to this Exhibit G.
