Box 2061 <br />Paonia, Colorado 81928 <br />Re: Bingham Crushing <br />Our File No. 82-159 <br />Dear FIr, Bi nkha m: <br />On August 25, 1982, the Mined Land Reclamation Board met in a formal public <br />hearing to consider levying a possible civil penalty against you for the <br />violation of minlnq without a permit (as found by the Board during their <br />July 21-22, 1982 meeting). A civil penalty of $2,000,00 was Zevied with all <br />but 5400.00 to be suspended if a permit is approved by the Board for this <br />operation within 60 days. The unsuspended portion of the penalty is payable <br />within 30 days, Pleases note that the Cease and Desist Order issued by the <br />Board (against a1I activities not directly concerning flood control) is to <br />remain~in effect until a permit is actually issued. <br />The next Mined Land Reclamation Board meeting will be held on September 22-23, <br />1982 in Durango, at the La Plata County Extension Building, located at 25th <br />and Main Street. Since', once your application is complete, you must publish <br />for 2 consecutive week:; in a local newspaper, I suggest that you send me the <br />remaining items needed for application completeness as soon as possible. <br />This will allow this matter to be heard by the Board during the September meeting. <br />I should mention that you can make both your application fee check and your <br />civil penalty check pavable to "State of Colorado".
