V J I'A5E 6 <br />Reeeptfon N'o~~',~~`~ta M tlolthus R~cordar <br />GRAVEL LEASE <br />AGREEMENT made and entered into this th day of May 1991, by and between Robert <br />Ferris, party of the first part, hereinafter called Lessor (whether one or more) <br />and Kiowa County, a political subdivision of the State of Colorado, party of the <br />second part, hereafter called Lessee. <br />WITNESSETH, that the said lessor for and in consideration of ten dollars and <br />other good and valuable consideration in hand paid, receipt of which is hereby <br />acknowledged and of the covenants and agreements hereinafter contained on the <br />part of the Lessee to be paid, kept and performed, has granted, demised, leased, <br />and let and by these presents does grant, demise, lease, and unto the said <br />Lessee, its successors and assigns, for the sole and only purposes of mining <br />gravel and other related substances and for conducting all operations as may be <br />convenient or necessary for the mining and removal of gravel and related <br />substances, including but not limited to the construction of roads, excavation <br />of gravel pits, reclaiming the same and doing all things as may now by or <br />hereafter become necessary to comply with the rules and regulations of the State <br />of Colorado and the United States of America, all that certain tract of land <br />together with any reversionary rights therein, situated in the County of <br />Cheyenne, State of Colorado, Described as follows, to wit: <br />9.8 acres within: <br />NE 1/4 NW 1/4 of Section 28, Township 16, Range 51 <br />It is agreed that this lease shall remain in force so long as Lessee conducts <br />mining operations thereon or a lease for 5 (five) years, renewal as long as able <br />to conduct mining operations thereon and until Lessor reclaims said property as <br />may be required by law. <br />In consid~zration of the premises the said Lessee covenants and agrees that the <br />Lessee shall pay to Lessor as royalty 20 cents per yard for all gravel and <br />similar substances removed from the premises. <br />It is und+nrstood and agreed that the Lessee shall have possession of the surface <br />of said premises during the term of this agreements. <br />Date: jam- a2 ~ -- ~ J <br />~, Ci • -~..~~ <br />Lessor ~ <br />i~~ .Jr <br />County Commissioner <br />SS: <br />T~~~~~~~~~~'g..,iire went was acknowledged before me on 2Tt~_day <br />~ <br />" <br />~ <br />1My issi <br />'!,,.~6~ <br />~~,'"' '"~'. <br />' on expires October 3, <br />' ..
