• Construction Summery <br />1n accordance with Rule 4, Pert 4.05.6(7) of the Rules and Regulations of the Colorado <br />Mined Land Reclamation Board pursuant to the Colorado Surface Coal Nining Reclamation pct <br />34-33-107 et seq., I, Ronald J. Gehrke, hereby rectify that the construction of <br />Sedimentation Pond 009 was inspected and constructed under my supervision. The <br />construction of Pond 009 vas supervised on site by Chuck MtCulloh, Oper of ions Engineering <br />Manager at the Seneca II-Y Mine. Chuck assured all work was performed in accordance with <br />the design and the specifications. t inspected the structure on November 21, 1991 to <br />verify the pond's conditions. I inspected the Pond 009 construction on May 26-27, 1992 <br />to verify the as-built conditions. 1, Ronald J. Gehrke, am a 1977 9reduete in civil <br />engineering end I have been a Registered Professional Engineer in Colorado since November <br />Z2, 1982. <br />The purpose of my inspection and certif icetion was to ensure proper construction of <br />Sedimentation Pond 009 and to satisfy the requirements of Rule 4.05.6(7) of the Colorado <br />Mined Land Reclamation Division. The material wea placed in the embankment to meet or <br />exceed the design specification (see Addendum 4 for compaction information). This <br />• as-built report confirms the Construction of this structure meets or exceeds the Rulec arW <br />Regulations of the Colorado Mined Land Reclamation Division. The structure is stable, <br />evidencing no indications of slope instability. <br />To the beet of my knowledge, based upon my pr of esaionel expertise, end to the extent <br />possible, Pond 009 at the Seneca fI-Y Mine was constructed in accordance with the prudent <br />state-of -the-art of earthen embankment Construction. further, the structure was <br />constructed in compliance with the approved design, to the extent possible, as specified <br />in Attachment 13-5 of Peabody Coal Company's eppr Dyed mine permit. Minor field adjustments <br />in horizontal end vertical alignment were necessary during construction to compensate for <br />unanticipated natural conditions, limit the disturbed area, and construct a structure <br />consistent with the existing and reclaimed topography. <br />i <br />13-SA-11 <br />
