-2- <br />April 16, 2007 <br />The additional 32 acres will be part of the proposed Fremont Paving Phase 1 <br />Area. This will increase the total acres in the Phase 1 Area from 60 to 92 total <br />acres. <br />2. There will be no changes in the mining or reclamation methods, materials and <br />agency recommendations as currently described in the application, only the <br />inclusion of the additional 32 acres to the Phase 1 area. The REJECT PILE will <br />be processed out and reduced as part of the Phase 1 activities and operations. It <br />is assumed by the applicant that the portion of the bond covering the REJECT <br />PILE would be mleased once the pile has been removed, sold and/or re-graded <br />to the satisfaction of the DRM&S. <br />3. Any of the tin-mined areas that remain in the former 111 permit areas (IvI-1998- <br />081 Permit Axea) will be mined as part of Phase 1 Area operations. It is assumed <br />by the applicant that any currendy bonded areas (in permit M-1998-081) that <br />have been previously mined and reclaimed will have the bond reduced or <br />released Materials and methods for mining and reclamation will be as stared in <br />Exhibits D and E as similar to other site disturbed areas. <br />Attachments <br />1. The revised page 1 of the DRM&S 112 Application Foxm to show 282 acres <br />total. <br />2. Revised Exhibit A -Site boundary description has been changed to include <br />additiona132 acres from the 111 Permit Areas and a total of 282 acres. <br />3. Revised Map Exhibits - Exhibit C -Mining Plan Map and Exhibit F - <br />Reclamation Plan Map; The west permit boundar~~ line was re~7sed and the 111 <br />Permit areas are now included in the proposed Phase 1 Area to total 92 acres. <br />I have also attached a copy of the Public Notice, to be re-published due to the <br />change in total site acres, beginning on 4/19/2007 for 4 weeks in the Huerfano World. <br />A copy of the actual notice and affidavit of publication will be forwarded to you as soon <br />as possible (available). The fmal comment date would be on May 30~h Due to the minor <br />revisions that required 3 separate publications (90 days - 12 weeks) and extended public <br />comment period, the applicant would appreciate the final DRM&S permit approval fox <br />this application as soon as possible. There have not been any letters or comments <br />received fox the previous notices and the County Special lise Permit has been approved <br />by the BOCC, also without any comments to the Counties notices ox during Planning <br />Commission and BOCC Hearings.
