<br />6.4.13 EXHIBIT M -Other Permits & Licenses <br />t5. In the event that there are jurisdictional wetlands present at the proposed NCCI Pit No. 1 site, <br />you may be required by the Corps of Engineers to obtain a permit and perform wetlands <br />mitigation or replacement during mining and reclamation. Please clarify whether a permit will <br />be required from the Corps of Engineers and whether provisions for wetland mitigation and/or <br />replacement will be incorporated into the proposed reclamation plan. <br />6.4.19 EXHIBIT S -Permanent Man-Made Structures <br />16. The applicant has provided a commitment to stay at least 200 feet away from all permanent <br />man-made structures until an agreement is reached with the owner. For clarification, this <br />commitment supercedes the setback distances (less than 200 feet) from such structures as shown <br />on the mining plan map. This agreement is appropriate and necessary for all roads, utilities, and <br />irrigation ditches that occur within 200 feet of the areas proposed for excavation. <br />Once again, I will look forward to your response on or before January 25, 2002 [o allow adequate <br />time for review before the February 18, 2002 decisioa date. Rule 1.8.1 states that changes and <br />additions to the permit application must be filed with the Division and the County Clerk and <br />Recorder.
