<br />• 43 <br />PERMANENT STRUCTURES <br />SEC 12 & 13, T35N, R17W, NMPM <br />STONE GRAVEL PIT <br />DAREN STONE- PROPRIETOR <br />EXHIBIT S <br />Permanent structures within two hundred feet include the following: <br />County Roads " 21" and "F" -unpaved all-weather public routes just outside the <br />permit area east boundary [Montezuma County <br />Roads Department] <br />Two residences -private dwellings east of County Road 21 and across C.R. 21 <br />from the site, having driveways, garages, storage buildings, <br />pump houses, swing sets, etc.[Bell & Campbell, Olin] <br />Overhead Power Lines -east right-of -way line of County Road 21 and <br />south right-of--way line of Road F [Empire Electric] <br />Buried Telephone Line -west right-of--way line of County Road 21 and <br />north right-of--way line of Road F <br />[U.S. West Communications] <br />Boundary Fence/Gate -south permit azea boundary [B.L.M./Messinger] <br />Fence/Gate - east and west county road right-of--way boundaries <br />[Montezuma County Roads Department] <br />- south permit area boundary [BLM/Messinger ] <br />- south of permit area southwest comer [Messinger/LJte Tribe] <br />Access Trails -across south quarter and northeast quarter of permit area <br />(prescriptive access easements) [Ute Tribe, Messinger, BLM] <br />County Roads " 21" and "F" aze more than 200 feet distant from any mining excavation <br />and can be shown to be reasonably safe from any structural damage likely to occur. <br />Access thereto from the operational site and the haulage use [hereof is permitted by the <br />Montezuma County Roads Department, wherein is the assurance of the structural <br />integrity <br />of the routes for operations haulage activity. <br />The power lines, and the two residences are more than 200 feet distant from any mining <br />activity, and being across the county road from the site as well, they and all [heir <br />appurtenances can be shown to be safe from damages likely to occur from mining <br />operations. All fences and gates are at least 100 feet from excavation activity and can be <br />similarly considered to be safe from structural damage from mining operations. <br />Unimproved access trails across the site must be left intact during permitted operations to <br />provide access to customary users and for access for mining operations.
