Stone <br />24600 County Road P <br />Dolores, Colorado 81323 <br />Mr. Stone: <br />In February 1997, you contacted this office regarding the <br />possibility of developing a gravel pit operation on BLM managed <br />public lands in the Cortez, Colorado vicinity. On April 25,1997, <br />you submitted a Land Use Application form (2920-1) requesting <br />permission to go upon these public lands for purposes of sand and <br />gravel resource testing. <br />The subject lands are located at: NMPM, <br />S25E and; sec 13: N2NE, Montezuma Count <br />patented lands were reconveyed (surface <br />United States of America on January 27, <br />reserved to themselves "all of the oil, <br />of every kind of nature". <br />T.35 N., R.17 W., sec 12: <br />~. The grantors <br />gas, and other minerals <br />We have concluded that the mineral estate is paramount to the <br />surface estate and that the owners, their heirs, and their <br />assigns do not need a BLM permit to go upon the surface for <br />activities related to the development of the minerals. <br />Therefore, we will not be issuing any type of permit for your <br />proposed operation as we have no authority to do so. <br />On a related matter, the BLM has identified two cultural sites on <br />the subject lands. One of the sites is potentially eligible to <br />the National Register of Historic Places. The BLM would like to <br />recover the cultural data contained within the sites before that <br />information is lost as a result of the development of the gravel <br />operation. We hope to be able to work with you to accomplish <br />this goal. We have provided this cultural site information to <br />you so that you may incorporate it into your Colorado Division of <br />Minerals & Geology, Reclamation Permit Application. <br />On still another related matter, on May 2, 1997, Mrs. Kathy <br />Stone, faxed to this office a copy of a March 10, 1997, letter <br />from Mr. Charles B. Stone of the American Cancer Society. <br />According to the March letter, the American Cancer Society and <br />the American Heart Association, are tenants in common and owners <br />of the mineral estate of the subject property. In the legal <br />description portion of the letter, Mr. Charles Stone indicates <br />that the subject mineral estate is 320 acres. <br />
