Box 54 <br />Division Direcor <br />Delta, Colorado 81416 ~ Natural Resource Trustee/ <br />RE: Benson Brothers Red Shale Pit, File No. M-2005-071°Vibration Monitoring Plan Adequacy Review " <br />Dear Mr. Ripp: <br />DBMS has completed review of the Revey Vibration Monitoring Plan submitted June 2, 2006 and the <br />addendum submitted October 25, 2006 to satisfy the one stipulation of the conditional approval for the <br />Benson Brothers Red Shale Pit Permit, File No. M-2005-071. The proposed monitoring plan will be <br />considered adequate to satisfy the requirements of Stipulation No. 1 upon submittal of a commitment that <br />states: <br />PreSeisTek, Inc. will certify that the seismographs conform to standards recommended by the <br />vibration section of the International Society of Explosives Engineers and that the instruments have <br />been calibrated by the manufacturer in the 12 months prior to their use at the site. <br />Upon submittal of this written commitment and an adequate performance warranty, the permit will be <br />issued.
