Verbal notification shellbegivenwithin241tours,andwrittennotificationshallbesubmittedtotheDivision <br />within 5 drays of mry discharge front the VLF that would qualify for this exemption. This will be in accordnr:ce to <br />the described method in Part LA.1(c) of the Permit. <br />c) S[orn Exemption Fron: Federal Effluent Limitations - Outfnll OOSB <br />Pursumtt to 90 CFR Part 440.131, if, as a result ofprecipitakon, the YLFhas a discharge which violates limitations <br />of 40 CFR Part 440 (New Source Performance Standards), the discharge may qualify for an exemptiot from such <br />limitations if the following conditions ere rnet: <br />i) The YLF is designed constructed and maintained to coruain the maximum volume of water stored and <br />contained by the VLFduringnornnl operating conditionswithout an increase in volume ofstored water from <br />precipitation plus the maximum volume of water resultingfrorn n 10 year, 24-hourprecipttattort event. In <br />computing the maximun volume of water, which would result from a 10-year, 24-hour precipitation event, <br />CC&Ytnust include the volume which would resultfrotn all areas contribuung runoff to the YLF. For the <br />purposes of this permit, the 10 year 24-hour rainfall depth has been determined to be 2.4 inches. <br />ii) CC&V takes all reasonable steps to minimize the discharge. <br />iii) All notification requirements of the permit ere complied with, including t/lose listed below. <br />CC&V has submitted information, both in comments to the Division and to the Stale Division of Minerals and <br />Geology, indicating that the VLF is designed, constructed and will be maintained to contain the water volumes <br />described above. However, should n discharge from the VLF become necessary, CC&V shall give verbal <br />notification to the Division immediately upon becoming aware ofan invninent discharge and such notice shall be <br />given no later thmt 24 hours after the beginning ofany discharge from the VLF that may qualifyfor the exemption. <br />A report must be submitted within 5 days of the said discharge, documenting Zha[ the VLF was maintained to <br />contain the volumes specified in i), above. The report shall also include documentation of the stone event, <br />including total precipitatiat as measured at a gauge statiat in close proximity to the VLF, or CC&V's own gauge, <br />where the precipitation was measured, the volume ofrunoffproduced mtd the steps taken to maintain treahnent and <br />minimize the amount of overflow.
