COLORADO D£PARTM£NT OF HEATH, Wnrer Qunliry~ Division
Rrnionnle - Pnge 8, Permir No. CO-0043648
Pursuant to 40 CFR Part 440.104, in the event that the nanual precipitation (measured ns a 365-day, moving
average) felling on the VLF and the drainage aren contributing surface runoff-to the VLF exceeds the armunl
evaporation (also measured as n 365-day moving average), n volume of water equal to the d~erence between
annual precipitation falling on the VLF and the drainage aren contributing surface rmmffto the facility and the
365-day moving average evaporation may be discharged subject to the limitations setforth in Table VI-2for Outfall
OOSB. Verbal notification shellbegivenwithin241tours,andwrittennotificationshallbesubmittedtotheDivision
within 5 drays of mry discharge front the VLF that would qualify for this exemption. This will be in accordnr:ce to
the described method in Part LA.1(c) of the Permit.
c) S[orn Exemption Fron: Federal Effluent Limitations - Outfnll OOSB
Pursumtt to 90 CFR Part 440.131, if, as a result ofprecipitakon, the YLFhas a discharge which violates limitations
of 40 CFR Part 440 (New Source Performance Standards), the discharge may qualify for an exemptiot from such
limitations if the following conditions ere rnet:
i) The YLF is designed constructed and maintained to coruain the maximum volume of water stored and
contained by the VLFduringnornnl operating conditionswithout an increase in volume ofstored water from
precipitation plus the maximum volume of water resultingfrorn n 10 year, 24-hourprecipttattort event. In
computing the maximun volume of water, which would result from a 10-year, 24-hour precipitation event,
CC&Ytnust include the volume which would resultfrotn all areas contribuung runoff to the YLF. For the
purposes of this permit, the 10 year 24-hour rainfall depth has been determined to be 2.4 inches.
ii) CC&V takes all reasonable steps to minimize the discharge.
iii) All notification requirements of the permit ere complied with, including t/lose listed below.
CC&V has submitted information, both in comments to the Division and to the Stale Division of Minerals and
Geology, indicating that the VLF is designed, constructed and will be maintained to contain the water volumes
described above. However, should n discharge from the VLF become necessary, CC&V shall give verbal
notification to the Division immediately upon becoming aware ofan invninent discharge and such notice shall be
given no later thmt 24 hours after the beginning ofany discharge from the VLF that may qualifyfor the exemption.
A report must be submitted within 5 days of the said discharge, documenting Zha[ the VLF was maintained to
contain the volumes specified in i), above. The report shall also include documentation of the stone event,
including total precipitatiat as measured at a gauge statiat in close proximity to the VLF, or CC&V's own gauge,
where the precipitation was measured, the volume ofrunoffproduced mtd the steps taken to maintain treahnent and
minimize the amount of overflow. Submittal of documerantion of containment, maintenance, and precipitation
records above does not exempt CC&V from any other notificatiat requirements of this permit.
