Simpson, Assistant State Engineery~ ~ .~ <br />SUBJECT: Robinson Brick $ Tile Company <br />As requested, we have reviewed the above referenced application for dry pit <br />clay mining near Morrison. The application indicates that the main source of <br />water in the mining area is expected to come from minor runoff. Robinson <br />cannot legally detain or use site runoff when there is a call on the over- <br />appropriated Bear Creek basin unless they have a senior adjudicated water <br />right which allows the use of runoff for mining purposes. We do not have <br />record of such a water right existing in this area. Therefore, it does not <br />appear Robinson has a reliable source of water. We cannot recommend approval <br />of this application until we are assured that Robinson does have a legally <br />reliable source of water.
