• III IIIIIIIIIIIIIIII • <br />LEASE AGREEMENT <br />THIS LEASE AGREEMENT is made and executed as this 3~ day of December, 1996, <br />between CARROLL DAVIDSON PARTNERSHIP, LTD., doing business as DAVIDSON <br />YELLOW JACKET RANCH, LTD., herein afterwards referred to as "Yellow Jacket", whose <br />address for purposes of this Agreement is c/o Davidson Enterprises, Inc., 3525 Murrell Road, Suite <br />3-C, Rockledge, Florida 32955 and CORN CONSTRUCTION CO., a New Mexico corporation, <br />whose address for purposes of this Agreement is P.O. Box 1240, Grand Junction, Colorado 81502 <br />("Corn"). <br />RECITALS <br />A. Yellow Jacket is the owner of real property located in Rio Blanco County, Colorado, <br />and the sand and gravel contained in and on such property, which property is described in Attachment <br />A (the "Property"). <br />B. The Property contains sand and gravel and Yellow Jacket desires to allow Corn to <br />mine and process sand and gravel on the Property and to use such sand and gravel as Corn produces <br />for highway construction and other commercial purposes. <br />C. Yellow Jacket desires that Corn pursue and receive all necessary gravel pit permits <br />for operation of said gravel pit in accordance with the requirements of Rio Blanco County, the <br />Colorado Mined Land Reclamation Board, and the Colorado Department of Health. <br />D:V.tArTCORMCARROLLLEA I7eccmbtt 5, 1996 <br />
