Re: Application of Henry T. Southway, Jr., d/b/a So. Way Co. for
a conditional use for the establishment of an extractive
industry (sand and gravel) to be located on a fraction of
Section 31, Township 28 South, Range 73 West, Sixth
Principal Meridian pursuant to Section 23(a) of the Zoning
Regulations of Alamosa County, 1975, as amended.

Wf3EREAS, an application for a conditional use review
requesting allowance of the establishment of an extractive
industry (sand and gravel) has been received together with
certain attachments and exhibits as required by Article 3 of the
Alamosa County Zoning Regulations, 1975, as amended, the business
to be located upon the following property:
A parcel of land being a part of Section 31, Township
28 South, Range 73 West, 6th Principal Meridian, Alamosa
County, State of Colorado.
Beginning at the Northeast corner of Section 6, Township 36
North, Range 13E, NMPM, a 1972 BLM brass cap; thence S
O1°51'W along the.west line of said Section 31 a distance
of 1320.00 feet; thence S 88°09'E a distance of 1320.00
feet; thence N O1°51' E a distance of 1320.00 feet; thence
N S6°09';•; a 9i~tance cf 1320.00 feet to the point of
beginning, containing 1,742,400 square feet or 40 acres,
more or less.
said property being zoned Rural (RU) District; and
WHEREAS, a public hearing was held before the Alamosa County
Planning Commission on January 18, 1984, upon proper notice, and
thereafter the Planning Commission recommended acceptance of the
conditional use herein to the Board of County Commissioners of
Alamosa County, upon certain conditions; and
WHEREAS, a public hearing was held before the Board of
County Commissioners on February 23, 1984, at which time the
applicant appeared; and
WHEREAS, testimony in support of the conditional use was
presented, and;
WHEREAS, there was no opposition to the application; and
WHEREAS, the Board of County commissioners has considered.
the application, the recommendation of the Planning Commission,

County Zoning Regulations pertaining thereto and that the
establishment of an extractive industry (sand and gravel) at' this
location is permitted as a conditional use for such property by
Section 23(a) of the Zoning Regulations of Alamosa County, 1975,
as amended; and
WHEREAS, the proposed use is Consistent with the ob}ectives
and purposes of the Alamosa County Zoning Regulations and is also
compatible with surrounding land use; and
