<br />KNOW ALL MEN BY THESE PRESENTS, That we, JAKE KAUFFMAN
<br />& SON, INC., of the County of Larimer, in the State of
<br />Colorado (hereinafter referred to as "Operator") have sub-
<br />mitted an Irrevocable Letter of Credit in the sum of Seventeen
<br />Thousand Five Hundred Dollars {$17,500.00) unto the State of
<br />Colorado, acting through the Mined Land Reclamation Board, a
<br />copy of which is attached hereto as Exhibit "A". By this
<br />submission we hereby bind ourselves, and each of our legal
<br />representatives, executors, administrators, successors and
<br />assigns, jointly and severly, firmly by these presents.
<br />WHEREAS, the Operator has applied for a life of the
<br />mine sand and gravel mining permit from the Mined Land
<br />Reclamation Board to conduct sand and gravel operations on
<br />the following premises, to-wit:
<br />The S 1/2 of the NE 1/4 and N 57-1/2 rods of N 1/2 of the
<br />SE 1/4 of Section 20, Township 5 North, Range 68 West of
<br />the 6th P.M., except 31-1/2 A. heretofore conveyed to G. S9.
<br />Sugar Company by deed dated June 20, 1907, recorded
<br />July 3, 1907 in Book 232, Page 302; also except strip
<br />heretofore excepted iii conveyance to C. A. Coykendall and
<br />J. B. Coykendall by deed dated April 24, 1906, recorded
<br />April 26, 1906 in Book 220, Paqe 329; together with all
<br />right, title and interest in Coykendall Ditch as the same is
<br />filed for record in office of State Engineer, June 3, 1906,
<br />District 4, Irrigation District No. 1, claiming 3.15 ft. of
<br />water per second of time. With all ditches, laterals and
<br />rights of way used in conveying water to said above described
<br />land; less, also, the 1 A. located in NIA corner of above
<br />described property previously deeded to Lewis L. Teuscher and
<br />Esther Teuscher in Book 1223, at Page 524, total property
<br />consisting of 105 acres, together with all water rights
<br />appertaining thereto.
