and Rules authorize DRMS to address stabilization ofreclaimed areas for wind erosion. To address this <br />issue the Applicant has committed to concurrent reclamation to reduce the volume of material onsite at a <br />point in time. The Applicant also has also stated in the application submitted to DRMS that they "will <br />apply the temporary seed mixture recommended by the NRCS to topsoil stockpiles if they aze left in <br />place for longer than one year." It is also stated that the Applicant anticipates that "most topsoil will be <br />replaced in concurrent reclamation during annual campaign mining." <br />In addition, the Applicant has also stated that mining is anticipated to occur in "short (typically less than <br />60 day) campaigns each year" and that "the clay mine is intended to ship raw materials to the Applicant's <br />brick plant without extensive handling prior to shipment." <br />3. Visual Impacts, Quality of Life, and Property Values <br />Multiple objectors raised a concern over the visual impacts resulting from the operation; how their <br />quality of life will be affected; and how the presence of the operation will affect their property values. <br />DRMS Response <br />The Construction Materials Rules and Regulations and the Act do not specifically address aesthetics <br />issues, quality of life issues, or property values related to construction material operations. <br />4. Noise <br />Multiple objectors raised concerns regarding noise resulting from mining activity. <br />DRMS Response <br />Land use and zoning issues fall under the jurisdiction of the county, and the Construction Materials <br />Rules and Regulations and the Act do not specifically address issues related to noise pollution or quality <br />of life issues. <br />III. DIVISION RECOMMENDATION <br />It is the Division's determination that the Applicant has fulfilled all of the requirements for approval ofa <br />reclamation permit for the Kiowa Clay Mine site, and recommends that the permit for the site be <br />approved. <br />4 <br />
