DANIELSON, DEPUTY STATE ENGINEER <br />SUBJECT: MOBILE PREMIX - HOWE PIT, ADAMS COUNTY, APPLICATION FOR MINING <br />AND RECLAMATION PERMIT <br />As requested by your office, we have reviewed the application fora gravel <br />pit near Henderson. We cannot recommend approval of the application until <br />the following additional information is provided: <br />Exhibit D indicates that a water truck, crushers, screens, and a <br />screw washer will be utilized during mining. Water for dust control <br />and gravel washing will be required for this equipment, but the <br />applicant has no source of water decreed for mining or industrial <br />purposes. The two irrigation wells might be changed to industrial <br />use, but even then they could not be pumped during much of the <br />irrigation season unless operated under a court approved plan for <br />augmentation. The applicant must obtain a legal, dependable source <br />of water in order to prevent injury to adjudicated water rights in <br />the over-appropriated South Platte Basin. <br />The reclamation of the pit (Exhibit E) will leave 2 lakes with over <br />200 acres of surface area. These lakes will perpetually evaporate <br />over 450 acre-feet of water each year and this evaporation will have <br />a measurable, detrimental effect on the prevailing balance of the <br />South Platte River. A solution to this measurable material injury <br />has not been proposed by the applicant. If an augmentation plan <br />is utilized to prevent injury, the augmentation water must be <br />permanently attached to the land through covenants, deed restrictions, <br />or other legal means. <br />Cl.
