Oe 7er, Reclamation Specialist RE: File No. M-92-016 The following items must be addressed by the applicant in order to satisfy the applicable requirements of C.R,S. 34-32-101 et sew. and the Mineral Rules and Regulations of the Mined Land Reclamation Board. General 1. You have provided the Division a copy of a public notice placed in the Canon City Daily Record; however, in accordance with Rule 2.2.2.(2), you have not provided proof of publication. Please provide this proof. Z. You have provided a list of certified mailings and certified mail receipts. In accordance with Rule 2.2.2(6), provide proof of required notices by providing copies of signed return receipts. Exhibit D - Mine Plan At this time Rocky Mountain Materials and Asphalt, Inc. has no plans to mine the Phase VI area. Neither a mine plan nor reclamation plan for this area was submitted with the application. Provide a revised Mine Plan Map that does not indicate that this area will be affected by mining activities. Also remove reference to the mining of this area from the Mining Plan Narrative. This phase should be added to the permit as an amendment after the permit is issued. An alternative to this would be to provide mining and reclamation plans plus a list of permits applied for regarding the mining of this area. If this alternative is chosen, you will have to notify ail applicable parties and a new date would be set for consideration by the Division. 2. A power line owned by West Plains Electric is located within land to be affected by mining. The mine plan as stated could adversely affect the stability of the power poles. Provide detailed plans for the method you will use to protect the stability of the poles. Or, provide a copy of an agreement between west Plans Electric and Rocky Mountain Materials and Asphalt, Inc. that states that damage to the power line will be compensated for by the mine operator.
