If a4Y such markers are removed or dostruyed by <br />Hall-Irwin, Ball-Irwin shall replace the same at Hall-liwin's sole cost and expense. <br />c. Hall-Irwin will not allow any extraction to ooctu, commencing at the surface of the <br />original ground, closer than 25 feet from any flowline or pipeline of Merit without <br />the express written consent of Merit and provided that trpom completion of such <br />extraction closer rhea 25 feet to a flowline, Hall Irwin shall back-fill and level the <br />area within 2S feet from any flowline or pipeline. The foregoing does not affect or <br />relate to the crossing of Merit's pipelines or IIowlinea by Aa11-Irwin with its <br />planned slurry wall and trendy provided that at all times Merit shall have access to <br />its pipelines and flowlittes. Hall-Irwin shall notify Merit at least 5 business days <br />prior #o commencing construction grid trenching of its slurry wall, and shall protect <br />Merit's pipeline and tlowline during sash operations. <br />d. Hatt-Irwin shall not allow any stockpile of soil exceeding 5 feet in. depth to be <br />placed over any flowline or pipeline of Merit <br />c. When crossing Meritpipelines with heavy equipmein,like earth moving equipment, <br />Hall-Irwin will maintain a mi~tml of Ecru feet end a m~Y+*rTM*+ of six feet of dirt <br />coverage, in addition to the existing cover over the pipeline. When crossing Merit <br />pipelines with trucks and lighter equipment, Hall-Irwin will maintain a minimum <br />of two feet and a maximtun of six feet of dirt coverage, to the existing cover over <br />the pipeline. <br />f. The depth of cover ova the Merit pipelines shall not be reduced or drainage over <br />Merit°s pipelines altered without Merit's written approval. <br />g, Any utility crossing must be a minimum of 18" inches vertical separation from <br />Merit pipelines or flowlines, The foregoing does net a$ect or relate to the crossing <br />of Merit's pipelines or tlowlinos by Hall-Irwin with its planned slurry wall and <br />trencl't, provided that ai all times Merit shall have access to its pipelines and <br />flowlines, Hall-Irwin shall notify Merit at least 5 business days prior to <br />commencing construction and trenching of its slurry wall, end shall protect Merit's <br />gipeline and ftowlirte dntin$ such operations. <br />Page 4 of 12 <br />
