~~ <br /> <br /> <br />RIDER TO MINING PERMIT <br />Permit Date: September 9, 1999 <br />Permit No: M-99-034 <br /> <br />The following additional stipulations and conditions form an integral part of the foregoing permit <br />Stipulation No. DescripUOn <br />Engineering designs, specifications, a conswction timetable, and a quality assurance plan for <br />the slurry wall will be incorporated into the permit via a technical revision prior to <br />commencement of conswction of the slurry wall. Camas Colorado, Inc. will provide the <br />division with a construction report and a certification that the slurry wall was installed in <br />accordance with the approved plans and specifications at the conclusion of the installation. <br />U the event of any drawdown of the Miriam J. Bromley and K.T. Barr, Inc. (Bromley and Barr) <br />wells and lakes (as indicated in erzhibit A attached to the July 22, 1999 indemnification <br />agreement between CAMAS and Bromley and KTB), to the e~~tent Bromley and KTB are <br />unable to recover and use the amounts of water historically taken Gom the Bromley and KTB <br />wells and lakes, it shall be presumed, in the absence of substantial, credible evidence to the <br />contrary that such drawdowo is a result of the mining activities of CAMAS on the camas <br />property. >f CAMAS cannot demonstrate to the Board's satisfaction through substantial, <br />credible evidence that any drawdovm that adversely impacts the historic use of the Bromley and <br />KTB wells and lakes has not been caused by CAMAS mining activities, then the drawdown <br />shall be considered an adverse impact to otTsite property and water quantity as established in <br />Section 34-32.5-116(4)(h), C.RS. and Conswction Materials Rule 3.1.6(1), and within 60 <br />days CAMAS shall present to the board and implement a satisfactory mitigation plan to restore <br />the historic amounts of water available in the Bromley and KTB wells and lakes. <br />MINED LAND RECLAMATION BOARD <br />COLORADO DEPARTMENT OF NATURAL RESOURCES <br />MICHAEL B.
