<br />EXHIBIT G - SOURCE OF LEGAL RIGHT TO ENTER <br />Mining Lease <br />Lease made this ~ day of 1986, between EDWARD <br />W. CECIL of the County of Washington, ate of Colorado, herein referred to <br />as Lessor, and THE BOARD OF COUNTY COMMISSIONERS OF WASHINGTON COUNTY, of <br />the County of Washington, State of Colorado, herein referred to as Lessee. <br />Lessor, in consideration of the agreements set forth herein to be kept <br />and performed by Lessee, and of the payment of royalties by Lessee as <br />provided herein, and subject to the terms, conditions, and provisions <br />contained herein, leases to Lessee a tract of land situated in the <br />Northeast Quarter of Section 25, Township 4 South, Range 49 West of the 6th <br />P.M., for the purpose of mining, removing, and marketing therefrom all <br />sand, gravel and rock located within the confines of the gravel pit permit <br />which will be issued by the Board of Mined Land Reclamation of the State of <br />Colorado, all of which are herein referred to as materials. <br />This le se shall be in effect or a per d of 1 year from <br />cZ 1986 to `q 1987. Lessee shall <br />have a right and option to renew thi lease for successive periods of one <br />year each ~ex~tending from the termination date of each succeeding year for a <br />total of <c v years. <br />Lessee shall pay to Lessor, as royalty, $.30 for each cubic yard of <br />materials removed from the premises. Lessee shall forward to Lessor <br />monthly reports showing the quantity of materials removed during the <br />preceding month, according to truck loads, with dates of loading. Each <br />report shall be .accompanied with a check from the Lessor to the Lessee for <br />payment of the preceding month's material. <br />Lessee may clear brush and undergrowth from such portions of the <br />leased premises as may be reasonably necessary to explore for materials or <br />to locate pits, quarries, and stockpile areas. Lessee shall have the right <br />to make use of all roadways presently existing on the leased premises, and <br />shall have the further right to build such additional roads as may be <br />necessary for the production and removal of materials hereunder. <br />In digging pits for the purpose of producing and removing materials <br />hereunder, Lessee agrees to make separate stockpiles of topsoil and of <br />waste substances. Lessee agrees that on the completion of the removal of <br />materials from the pits that have been dug on a leased premises, Lessee <br />will place any unused waste substances and materials used for roadways back <br />into the pits from which such substances and materials were removed, with <br />topsoil placed on top, and Lessee will back-slope such pits, using such <br />substances and materials as have been removed from such pits. The <br />restoration of the surface shall be in accordance with the rules and <br />regulations promulgated by the Mined Land Reclamation Board of the State of <br />Colorado. <br />In the event of any default in the performance of any term or <br />condition of this lease by Lessee, Lessor shall have the right to give a 30 <br />
