Z 266 437 610 <br />RETURN RECEIPT REQUESTED <br />DECISION <br />Cottonwood Land Company <br />NGAL- 02 <br />1475 Pine Grove Road ;207 Applicatic <br />Steamboat Springs, Colorado 80487 Filed Marc <br />Right-oE~Wav Grant Amended <br />On March 24, 1997, Cottonwood Land Company was granted right-oE~way (R/`A) <br />COC60125 under the authority of Title V of the Federal Land Policy and <br />Management Act of October 21, 1976, (90 Stat. 2776; 43 USC 1761) for a ~2 <br />watering monitor structure (flume) on public land in T.4N., R.89W., section 22 <br />(SEi/,SW3{), 6th P.M., Routt County, Colorado. <br />Cottonwood Land company filed application on March 23, 1998, to amend R/W <br />grant COC60I25 for an additional 50 feet by 50 feet area adjacent to and north <br />of the existing authorized site to install a groundwater monitoring well. <br />The grant of March 24, 1997, is hereby amended to authorize a groundwater <br />monitoring well. The R/'A amendment is 50 Eeet by 50 feet, comprising 0.06 <br />acres, as depicted on the map labeled Exhibit B-1. Item 2b of the grant now <br />reflects the R/W area is 50 feet wide, 100 feet long and contains a total of <br />0.12 acres more or less. This amendment is issued subject to the holder's <br />compliance with all applicable regulations contained in 43 CFR 2800. All <br />terms, conditions, and stipulations of the original grant shall remain in full <br />force and effect. <br />The required processing and monitoring Eees have been paid. The rent is <br />current. <br />47ithin 30 days of receipt of this decision, you have the right of appeal to <br />the Board of Land Appeals, Office of the Secretary, in accordance with the <br />regulations at 43 CFR 4.400. If an appeal is taken, you must follow the <br />procedures outlined in the enclosed Form 1892-1, Information on Taking Appeals <br />to the Board of Land Appeals. The appellant has the burden of showing that <br />the decision appealed is in error.
