do so. Licensor shall not be liable to Licensee in the event any structures are damaged or destroyed after the <br />expiration of said sixty (60) day period. All of the rights, duties, benefits, terms and covenants contained <br />herein will rttn wit the land and shall accrue to and be binding upon the successors and assigns of the <br />parties. <br />Section 4. No Warranty. <br />Licensor does not warrant or represent that the Property is safe, healthful or suitable for the <br />purposes for which it is to 6e used under the terms of this License, nor does Licensor warrant the Property <br />in any other way whatsoever. <br />Section 5. Damaee To Licenser's Property <br />Licensee agrees to pay for damage to growing crops, pasturage, timber, fences, drain tile, buildings, <br />or any other property of Licensor damaged as a result of Licensee's exercise of the privileges granted under <br />this Agreement. Licensee shall not perform any disorderly conduct or commit any nuisance on the Property <br />or use the Property in any way so as to interfere with the exercise of privileges which Licensor may have <br />given other licensees or permitees in the Property. <br />Section 6. Insurance and Indemnification. <br />Licensee during the term of this License Agreement and for one (I) year thereafter shall fully <br />indemnify, defend and save Licensor free and harmless aeainst any and all claims, damases, loss and <br />expense, includins attorney's fees and other leeal expenses, by reason of liability imposed or claimed to be <br />imposed by law upon the Licensor for damage because of bodily injuries (including death at any time <br />resulting therefrom) or on account of damage to propem sustained by any person or persons arising out of <br />or in consequence of Licensee's use of the Propem described in this License Aereement whether or not <br />such bodily injuries, death or damage to property arise or are claimed to have arisen in whole or in part out <br />of the negligence or any other grounds of lesal liability, but excluding, however, any liability caused b}• the <br />sole negligence or willful misconduct of the employees or agents of Licensor. Without limitins the <br />foregoing, Licensee shall subscribe to and cant' insurance covering its work on the Property under this <br />Agreement. <br />Section 7. Limitation of Riehts. <br />Licensee agrees that it does not have, and shall not claim at any time, any interest or estate of any <br />kind or extent whatsoever in the Property, by virtue of [his License or its occupancy or use of the property <br />hereunder. <br />Section 8. Consent to Assienment. <br />No assignment of the License or any interest therein and no sublicense for any purpose shall be <br />made or granted by Licensee without the prior written consent of Licensor. Licensor hereby consents to <br />Licensee's sublicense to Licensee's subcontractors. <br />Section 9. Complete Aereement: Modifications. <br />The making, execution and delivery of this Agreement by License has been induced by no <br />representation, statement, warranties or agreements other than those herein expressed. This Agreement <br />embodies the entire understanding of the parties and there are no further or other agreements or <br />understandings, written or oral, in effect between the parties, relating to the subject matter hereof. This <br />instrument may be amended or modified only by an instrument of equal formality signed by both parties. <br />2 <br />
