BANTA, Dlraetor <br />ernor <br />C;~~ w ~> <br />D <br />LIMITED IMPACT OPERATION (110(2)) <br />APPLICATION PACKAGE OCT ]. 1990 <br />Appl icabi 1 i ty Mined Land <br />Reclamation Division <br />This package applies to a mining operation which affects less than 10 acres or extracts <br />less than 70,000 tons of mineral overburden or combination lereof per calendar year. <br />Ii you plan to conduct a mining operation which satisfies these criteria, then you <br />should follow the instructions provided in this package for filing an application. <br />Filing Requirements <br />You should obtain the Mineral Rules and Regulations from the Division (E2.00/copy) and <br />read Rules 3 and 6. To apply fora Reclamation Permit fora limited ilnbact operation, <br />two copies of the "Limited Impact Operation (110(2)) Application Form" and Exhibits A-F <br />and an application fee must be submitted to the Division. This package contains the <br />app ication form and instructions for preparing information for attachment as Exhibits <br />A-F. <br />Application Review Procedures <br />Upon receipt of the application form, exhibits and application fee, the Division will <br />review them and notify you within 10 days whether they contain the minimum information <br />required by the Mined Land Reclamation Act and Rule 3 of the Mineral Rules and <br />Regulations. If the application contains this information, then it will be considered <br />"complete", and you will be notified to proceed with the notification requirements of <br />Rule 3. If the application does not contain the minimum information, then you will be <br />notified of the information required to make 1t "complete". <br />Your application will be considered by the Division within 30 days after it is deemed <br />"complete". The Division will decide whether all of the applicable information •and <br />notice requirements of the Act and Regulations have been satisfied and whether the <br />criteria in Sections 115 and 120 of the Act apply. You will be notified of the <br />Division's decision concerning the application. <br />If the Division denies the application, you may appeal to the Mined Land Reclamation <br />Board for a final determination by submitting a written Request for Administrative <br />Appeal to the Division within 60 days of the date of decision. <br />Please note, additional information may need to be added to the application after a <br />"complete" determination in order to satisfy the applicable requirements of the Mined <br />Land Reclamation Act and the Mineral Rules and Regulations.
