<br />THIS PER"1IT is issued this 24th ~ of htny, 1978 by the Mined Land
<br />Reclamation Board, Department of Natural Resources, State of Colorado.
<br />W I T N E S S E T H
<br />WHEREAS, INCOLN COUNTY desires to conduct a(n) open mining
<br />operation, known a Stone Pit , for the p'urpoae of extracting open
<br />mined sand & gravel '
<br />WHEREAS, on May 24, 1978, LINCOLN COUNTY "FILED" an appli-
<br />cation, a reclamation plan and map, and the required fee, as required by law; and
<br />WHEREAS, on May 24, 1978, ~~~e rimed Lend Reclamation Board approved
<br />LINCOLN COUNTY's application and set bond; and
<br />WitER>;AS, on M:~y 24, 1978, the Pained Lind Reclamation Board accepted surety
<br />submitted by [,INC;OLN COUNTY and such date shall be considered the
<br />date of issuance of the permit and the anniversary date for all other purposes; and
<br />WHEREAS, [he Mined Land Reclamation Board has made a finding, for the purposes
<br />of issuing this permit, Chat:
<br />1) the application complies with [he requirements of the Colorado
<br />Mined Land Reclamation Act and all applicable local, state and
<br />Federal laws; and,
<br />2) [he operation will not adversely affect [he stability of any
<br />significant, valuable, and permanent man-made structures located
<br />within two hundred feet of the affected land, except where there
<br />is an agreement between the operator and the persons having ar.
<br />interest in the structure that damage to the structure 1s [o be
<br />compensated for by the operator; and,
<br />3) the proposed mining operations and reclamation can be carried out
<br />in conformance with [he requirements of C.R.S. 1973, 34-32-116,
<br />as amended (1976 Sess. Laws H.B. 1065); and
<br />WHEREAS, for the purposes of issuing this permit, [he opezator has made
<br />a satisfactory showing to the Board that he will employ during and after his
<br />open mining operations procedures reasonably designed to minimize as mu
<br />as practicable the aisruption from the open mining operations and =~!:'.
<br />provide for the rehabilitation of the affected land through the rehabili_aricn of plant
<br />cover, soil stability, water.resources, and ocher measures appropriate [o the
<br />subsequent. beneficial use eE such mined and reclaimed lands; and [hat In
<br />the even[ of the Eailure of his proposed reclamation plan, he will take whatever
<br />measures which may be necessary in order to assure the success of reclamation of
<br />the lands affected by his oPe11 mining operations; and,
<br />WHEREAS, Eor the purposes of issuing this permit, a copy ci the application
<br />approved by [he Mined Land Reclamation Board of [he State of Colorado is attached
<br />to this permit and Chereby becomes a part of the terms hereof.
<br />NOW, THEREFORE, pursuant to [he authority set forth in the Colorado ;tined
<br />Land Reclamation Act, Article 32 of Title 34, C.R.S. 1973, as amended, (1975
<br />Sess. Laws H.B. 1065) the Mined Land Declamation Board of the State of Colorado
<br />hereby issues a life of the mine permit to i.INCOLN COUNTY to engage in
<br />open mining for the purpose of extracting open
<br />mined sand b gravel vn the following parcel of ground, to wit:
<br />4.3 acres NW!yNW%, Section 15, T15S, R56W, Sixth P.P1., Lincoln County,
<br />State of Colorado
