<br /> <br />8. Operator will maintain and stabilize finished slopes at a maximum <br />angle not to exceed the approximate original contour of the Land or <br />to a ratio no steeper than two (2) horizontal to one ('1) vertical. <br />(The above can revert to a less steep elope to conform to local <br />zoning regulations?. <br />9. Land stabilization and reclamation will be maintained for a period <br />of three (3) years after all mining activities cease, and if the <br />property is sold, leased, or transferred in any manner, the new <br />owner, lessee, or person having control, must file a request to <br />succeed operator (LRB Form 7) with the Colorado Land Reclamation <br />Board or with the Commissioner of Mines, and shall agree to be bound <br />to the unexpired period of the three year term. <br />10. If operator plans to discharge into a waterway, then a permit <br />to discharge into same will be obtained from the Colorado Water <br />Quality Control Commission. <br />11. Operator will control erosion on or along haul roads by the use <br />of drainage ditches, culverts, or check dams. <br />12'.' Natural drainways or drainways constructed to alleviate flood <br />conditions in the area shall be kept free from overburden, stock- <br />piles and topsoil. <br />13. Operator w111 obtain permission from the state authorities before <br />using water from any waterway, to prevent usurping any adjudicated <br />water rights. <br />14. Trailers and/or buildings used for office, storage, and maintenance <br />shall meet local zoning regulations. <br />15. Special use or other forms of permits shall be obtained from the <br />county agency authorized to grant such permits. <br /> <br />16. Nothing in this agreement shall subrogate the operator's responsi- <br />bility for compliance with local county zoning requirement. <br />-3- <br />
