<br />LAND RECLAMATION BOARD <br />Department of Natural Resources <br />'~ - <br />III~II~II~II~~II~II <br />sss <br />oom 215, 1845 Sherman St. Telephone: .892-3401 <br />enver, Colorado 80203 <br />Land Stabilization and Reclamation Axreement <br />i <br />THIS AGREEMENT is entered into this day of .'' , <br />1974 by and between THE SPATE OF COLORADO, by and through its Director of <br />Natural Resources and the Land Reclamation Board (hereinafter referred to <br />as "State") and Schmidt Construction, Inc (hereinafter referred to as <br />"Schmidt"). <br />W I T N E S S E T H <br />WHEREAS, Schmidt desires to operate a sand and gravel pit in the <br />North '~, Section 13, the South '~, Section 12, and the Southeast '~, Section 13, <br />Township 16 South, Range 66 West, S1 Paso County, Colorado, better known as <br />the Christian Pit; and, ~~'~s ~s( ~s ~,c-goo rc..u) <br />WHEREAS, Schmidt has submitted a plan on the Proposed Land <br />Stabilization and Reclamation Procedures for the proposed sand and gravel pit <br />operations; and, <br />WHEREAS, Said Christian Pit will be operated for the purpose of <br />extracting sand and gravel for commercial marketing and, <br />WHEREAS, The Colorado Open Mining Land Reclamation Act provides <br />statutory authority for the Land Reclamation Board of the State of Colorado <br />to enter into agreements with operators or persons in charge of quarry <br />operations such as those contemplated by Schmidt to insure that the <br />necessary stabilization and reclamation work will be done to prevent land- <br />slides, floods or erosion. This section of the law further provides that <br />the Land Reclamation Board requires a performance bond conditioned upon the <br />faithful performance of the stabilization work required by the Board; and, <br />WHEREAS, The Land Reclamation Board has determined that the <br />mining operation to be conducted by Schmidt in said Sections 12 and 13 could <br />have an adverse-affect on the environment and could result in Landslides or <br />erosion if proper stabilization and reclamation procedures are not followed. <br />
