The Bowie No. 2 Mine obtains its dust suppression and sanitary water from the Deer Trail Ditch via the new pump station located on the Deer Trail ditch. During the 2002 calendar year, the Bowie No. 2 Mine consumed 198.36 AC- FT of water in order to produce 5,386,000 tons of coal. Pond evaporation for 2002 was estimated at 3.05 AC-FT per year. The addition of the estimated pond evaporation to the mine consumption produces a consumptive use of 201.41 AC-FT of water for the 2002 year and is less than the estimated 234.6 AC-FT estimated in the permit application. This usage indicates that water for dust suppression and fire prevention at the Bowie No. 2 Mine is currently averaging approximately 36.8 AC-FT per million tons of coal. At a production level of 6.0 million tons per year, water consumption should be about 223.85 acre-feet per year. The applicant has undergone a Section 7 consultations for 325.9 acre feet per year. Please refer to Biological Opinions dated Sept. 3, 1996, Dec. 10, 1999, Oct. 23, 2001, July 29, 2003 for 123.6, 113.0, 20.3 and 69 acre-feet respectively. As shown above, the addition of the refuse pile pond will increase the estimated consumptive use to 326.7 acre-feet. A Section 7 consultation will be required of an additional depletion of 0.8 acre feet for the addition of gob pile. The applicant holds a water right to use 0,5 cfs decreed to the Deer Trail Ditch for power and mining purposes with the date of appropriation of February 15, 1907. Full time use of this water right would supply the mine with 362 acre-feet of water. Therefore, the applicant has water rights adequate to supply the estimated water consumption for the Bowie No. 2 Mine. 2.04 - 70 - 1 ~ /03
