• <br />Application of Bowie Resources, Limited <br />Case No. 99 CW 2b3 <br />Ruling of Referee and Decree <br />Page 4 <br />14. The sources of the Bowie Resources Springs are as follows: Five of the Bowie <br />Resources Springs aze springs which aze tributary to Terror Creek. Thirty-two of the Bowie <br />Resources Springs are springs which aze tributary to Hubbazd Creek. Terror Creek and Hubbazd <br />Creek aze both tributary to the North Fork of the Gunnison River. <br />15. The date ofappropriation for all ofthe Bowie Resources Springs is October 31,1997. <br />The appropriation was initiated by survey of the subject springs and measurement of flows from the <br />springs, together with the formation of the intent to appropriate water as described in the Application <br />and other acts in furtherance of the appropriation. <br />16. The amount claimed for each of the Bowie Resources Springs is set forth on Table <br />2. All of the Bowie Resources Springs aze claimed as conditional water rights. <br />17. All of the Bowie Resources Springs will be used for industrial purposes and other <br />purposes incidental to the operation of the Bowie Mine No. 2, described in Paragraph 22, below. • <br />18. The Bowie Resources Springs aze located on lands owned and/or administered by <br />three different entities: Applicant, the BLM, and the Forest Service. The owner of the land on which <br />each of the Bowie Resources Springs is located is shown on Table 2. <br />19. Water is available for appropriation under these priorities. Applicant has established <br />that water can and will be diverted, stored, and/or otherwise captured, possessed, and controlled and <br />will be beneficially used, and that the appropriations can and will be completed with diligence and <br />within a reasonable time. <br />Findings Re: Third Claim for Relief <br />(Plan for Augmentation and Change of Water Rights) <br />20. Names of structures to be augmented: <br />A. The Bowie Sedimentation Ponds B, C and D, described in the Findings Re: First <br />Claim for Relief, above. <br />B.
