l <br /> <br />EXHIBIT D (RULE 6.3.4(d)): The Division understands that [he City, as landowner, might not want to reclaim that <br />portion of the haul road included in the permit area. However, there is nothing in the application describing how the <br />Q road is to be reclaimed, if it is decided to do so at the conclusion of the mining operation. <br />The applicant should indicate how the road will be reclaimed if, a[ the conclusion of mining, it is decided <br />to do so. <br />EXHIBIT E-MAPS (Rule 6.3.4(2) and (3): The Exhibit E maps have the same deficiencies as the Exhibit A map <br />was indicated to have. (See Exhibit A review above.) <br />The applicant should provide revised Exhibit E maps that include only the legal description of the land to <br />~~' be included in the permit area and outline all land intended to be included in the permit area with the type of line <br />[hat corresponds to the map legend. <br />EXHIBT' F (RULE 6.3.6): The Division understands that the applicant intends to shape the margins of the pit so as <br />to retain all storm water on site. This may represent a conFlict with the requirements of the State Engineer's Office <br />~~- in regard to water rights. <br />The applicant should commit to contact with the State Engineer's Office in regard to any requirements <br />there may be regarding [he retention of storm water on site and advise the Division of the results of that contact. <br />NOTE: The decision date for this application is January 2, 2001. Please respond fully to the adequacy issues <br />identified above enough in advance of that date that the Division will have time to review the responses, deal <br />with any remaining issues, and be able to consider approval at that time. U you cannot respond fully by <br />January 2, 2001, please provide a written waiver of your right to a decision at that time in order to avoid a <br />denial of [he application and to allow the permitting process to continue.
