Long <br />Division Dneclor <br />RE: Smuggler Mine Application (File No. M-95-097) Response to <br />letter dated November 24, 1995 <br />Dear Ms. Kay-Clapper: <br />The Division has received your recent letter, referenced above, <br />which contained two requests regarding the Smuggler Mine <br />application which was received by the Division on November 21, <br />1995. <br />In regard to your request for "All information regarding the permit <br />application...", I will convey your request to the Division's <br />administrative section who will contact you in regard to copying <br />the application. Due to the Division's limited resources, this <br />copying will have to be at your expense, but it can be arranged. <br />You should know, however, that the regulatory requirements placed <br />on applicants for reclamation permits such• as this one make it <br />necessary that a complete copy of the application be filed with the <br />County Clerk or Recorder for public review. You may find all the <br />information that you need by means of that copy of the application <br />and, consequently, may not require a copy be made specifically for <br />you. That decision, however, is entirely yours. <br />As for your request to extend the current comment period deadline, <br />such a deadline is set by state regulation as being 10 days after <br />publication of an advertisement of the filing of the application in <br />a newspaper of general circulation in the area of the proposed <br />operation. The Division cannot extend the comment period without <br />the agreement of the applicant. The December 4, 1995 date that you <br />mention, however, is not valid because the application received by <br />the Division has been judged to be incomplete. In such case, the <br />applicant will be required to re-publish once the application is <br />complete and a copy of the complete application available for <br />public review. The subsequent 10 day comment period will then <br />depend on the date of the re-published advertisement. <br />If you have any further questions, please feel free to contact me. <br />
