It is the Division of Minerals and
Geology's understanding that many of the owners of various structures will be agreeing to allow mining closer to
their structures than 200 feet. Therefore the Division is requesting that the applicants submit the Mining Plan
Maps showing both the required 200 foot setback and an additional boundary showing the "Proposed approved
setbacks upon receipt of agreements". Once any notarized agreements are obtained, the operator should submit
the agreement, along with a new map which will show the new approved boundaries. The Division will then
return a fetter to the operator stating that as part of the "Permit Clarification", the condition for approving the
mining into the additional distu[bed area has been met.
Please note that if the proposed expansion to within 200 feet of a permanent man-made structure is to be done
through an engineering demonstration of stability, rather than through a notarized agreement with the owner of
the structure, a revisiottto [he permit must be submitted as par[ of the approval process.
1'f you have any question, please contact me.
Sincerely,
G R ~jL ,ire ~"~~~~
-- ~
Environmental Protection Specialist
cr.
