• RULE 3 PERFORMANCE BOND <br />3.01 PERFORMANCE BOND REQUIREMENTS <br />This rule sets forth minimum requuements and responsibilities for 51ing and maintaining <br />performance bonds for surface coal mining and reclamation operations and coal exploration <br />in accordance with the Act. The rule also includes minimum requirements of determining <br />the amounts and periods of liability for performance bonds; it establishes minimum <br />standards for the form, conditions and terms of performance bonds, as well as the schedule <br />and procedures for release bonds and the applicable provisions for forfeiture of all or any <br />part of a performance bond. <br />Since all ]ands related to mining disturbance were reclaimed in 1991, the only lands left to <br />be reclaimed are related to sediment control structures. These include the five sediment <br />ponds, sediment ditches, and topsor7 stockpile A which will be uti]ized for this reclamation. <br />Calculation of reclamation cost for these areas is contained on the following calculation <br />forms. <br />The basis for the reclamation cost estimate is the amount of material to be moved during <br />grading and topsoiling activities. The following yardages apply to the cost estimate. <br />Pond 002 Subsoil 0.6 acres 2,275 yards' <br />Pond 003 Subsoil 0.3 acres 1,200 yards' <br />Pond 004 Subsoil 0.7 acres 5,375 yards' <br />Pond 005 Subsoil 0.4 acres 2,090 yards' <br />Sediment Trap 0.6 acres 4,500 yards' <br />Diversion Ditches 6.8 acres 10,900 yards' <br />Topsoil 0.3 acres 10,000 yards' <br />Total 9.7 acres 3640 yards' <br />These yardages are based on pond and ditch design information contained in Section 2.05 <br />of the permit. <br />The original bond amount for the property was $800,000. Following the 1991 reclamation <br />activities, the CMLRD approved a $480,000 Phase I reduction for the property, leaving a <br />bond amount of $320,000.
