<br /> <br />Grand Junction Pipe & Supply Company -2- April 19, 1999 <br />Finally, this Boazd would want you to purchase a performance bond to guarantee your <br />compliance with the conditions and your agreement to cease and desist operations as provided <br />herein, which bond (or letter of credit if you wish) may be called upon by the County should you <br />fail to comply herewith or fail to cease and desist your operations after notice and opportunity to <br />cure as provided herein. That bond will be in the amount of $ 25.000.00 <br />The conditions which you have agreed to comply with.with respect to the Delta Paving <br />Gravel Pit are as follows: <br />Hours of operation will be from 6:00 a.m. through 6:00 p.m. Monday through <br />Saturday only. The only operation which may be allowed to continue through tlic <br />night and on Sundays will be pumping. <br />2. With respect to the nighttime and Sunday pumping, this Board would want you to <br />use electrical motors for pumps, if power to run the pumps can be obtained at <br />reasonable expenses from the existing power lines which cross Lot 2. Whether you <br />use electrical or diesel, your pumps and motors must be housed in a sound reducing <br />building with a residential muffler. <br />3. All of your lights must be hooded so that the neighbors on the ridge of the hill aze not <br />disturbed and the night sky is not illuminated <br />4. For purposes of dust suppression, the access road from State Highway 65 through the <br />field in Lot 2 of the Volk Minor Subdivision must be paved, with the road from the <br />field to the processing area graveled. Dust suppression in compliance with the Air <br />Emission Permit which will be obtained from the Colorado Department of Public <br />Health and Environment for the gravel mining operations on the Volk Property must <br />be maintained on all gravel roads, including internal haul roads to the stockpile acid <br />the processing area. <br />Any trees larger than 6 inches in diameter that are removed must be replaced two {2} <br />planted for every one (1) removed. You must maintain the existing trees between <br />Lot 2 and the pit and processing area as viewed from Highway 65 as a buffer area.. <br />A representative of this Board and a representative of the State Forester or CSU <br />Extension agent familiar with trees shall visit the site, identify and mazk all Fremont <br />Cottonwood trees, All large, healthy Fremont Cottonwood trees mustbe preserved; <br />except that any trees which substantially interfere with the mining plan as approved <br />by the Mine Land Reclamation Board maybe removed if either transplanted or <br />replaced two {2) trees for every one (1) removed in a different area. <br />F:\COUN'MVolk-8000 letter agmt (BKK) <br />
