NOTICE <br />Please take notice that Kerr Coal Company, a Colorado corporation <br />("Kerr Coal"), Post Office Box G, Steamboat Springs, Colorado 80477, has <br />submitted an application to the United States Department of the Interior, <br />Office of Surface Mining, and to the Colorado Mined Land Reclamation <br />Board for the issuance of permits to conduct surface mining operations <br />pursuant to the Surface Mining Control and Reclamation Act of 1977, 30 <br />U.S.C. 5 1201 et seg, and the Colorado Surface Coal Mining Reclamation <br />Act of 1979, 1973 C.R.S. ~ 34-33-101 et sec. <br />The area which will be subject to surface mining activities by Kerr <br />Coal is divided into two parts; the Kerr Mine Area and the Kerr Tipple <br />Area. <br />• The Kerr Mine Area, situated in the northeastern portion of North <br />Park, Jackson County, Colorado, is located approximately 10 miles east <br />of Walden on Jackson County Road No. 12E. The eastern boundary of the <br />Kerr Mine Area is nearly parallel with and approximately 1-k miles west <br />of the Canadian River. The Michigan River parallels the Kerr Mine Area <br />on the west and is located approximately 4 miles away. The northern and <br />southern extremities of the Kerr North Area are bounded by Sudduth Draw <br />and Bolton Draw, respectively. <br />The Kerr Tipple Area is situated 1 mile south of Walden, Colorado, <br />adjacent to Colorado State Nighway No. 14, and along the Union Pacific <br />Railroad line. Located immediately west of the Kerr Tipple Area is the <br />Illinois River. The property is bounded on the south by the Arapaho <br />National Wildlife Refuge. <br />A map showing the exact location and boundaries of the permit area <br />is set forth on the following page. <br /> <br />
