~ III IIIIIIIIIIIII III ~ <br />:-r,y.~ . <br />U~- r ' <br />~ ~C,~ <br />BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />File No. M-97-089 <br />IN THE MATTER OF THE STONE GRAVEL PIT APPLICATION <br />FINAL DECISION AND ORDER <br />The Formal Public Hearing on the Slone Gravel Pit Application was held on February 25, <br />1998, during the regular meeting of the Mined Land Reclamation Board ("the Board"), at 1313 <br />Sherman Street, Room 318, Denver, Colorado. <br />PRELIMINARY MATTERS <br />The Boazd reviewed the Proposed Pre-Hearing Conference Order, noted the fact that no <br />objections had been filed with the Division of Minerals and Geology ("the Division") and <br />adopted it with the following amendments to allotted time only (at page 7) as follows: (A) <br />Presentations and Cross-Examination: " 30 minutes" each for the Division and the Applicant was <br />reduced to " 25 minutes;" "5 minutes" for each recognized party and each member of the public <br />was reduced to " 3 minutes" each. (B) Rebuttal Statements: " 20 minutes" each for the Division <br />and the Applicant was reduced to "l5 minutes;" "5 minutes" for each recognized party was <br />reduced to " 3 minutes" each. (C) Closing Statements: "5 minutes" for each recognized party <br />was reduced to " 3 minutes" each. <br />FINDINGS OF FACT, CONCLUSIONS OF LAW AND ORDER <br />Following disposition of the Preliminary Matters, the Board proceeded to consider the <br />Proposed Application. <br />The Division of Minerals and Geology ("the Division") was represented by Assistant <br />Attomey General Stephen M. Brown. Assistant Attomey General Jill M.M. Gallet appeared as <br />Counsel to the Board. Sam W. Maynes, Esq. appeared on behalf of Applicant Dazen Slone. <br />Travis E. Stills, Esq. appeared on behalf ofparty-objectors Rick Bell, Susie Bell, Ric Emerson, <br />Lynda Emerson, Buck Morris, Betty Morris, Ruth Stickman, Nelda Troust, Rocky Troust and <br />Warren Lowe. <br /> <br />
