6. Objectors' Allegation That Allen's Application Is Incomplete Because Allen <br />Failed To Provide Proper Notice To "Mr. Cargill" As An "Owner Of Record" <br />Of Mineral Rights In The Subject Property Is Unfounded. <br />a. N.C. Cargill is not an owner of record to whom Allen should have given <br />notice. <br />Objectors have argued that the reservation of certain mineral rights in favor of N.C. <br />Cazgill and Lora E. Cazgill contained in a 1963 Warranty Deed recorded in Pazk County, <br />Colorado, establishes "Mr. Cazgill" as an Owner of Record to whom Allen should have given <br />notice of its application pursuant to Rule 1.6.2(1)(e)(i). See 1963 Warranty Deed (Exhibit 2). <br />While it is uncertain whether Objectors' reference to "Mr. Cazgill" pertains to N.C. Cazgill or <br />his son, Robert Cazgill, it is cleaz that Allen was not required to give notice, pursuant to Rule <br />1.6.2(1)(e)(i), to any member of the Cargill family. Neither N.C. Cazgill nor Lora E. Cazgill <br />were living at the time Allen submitted its application-N.C. Cazgill died in 1978, and Lora E. <br />Cazgill passed away in 1993. See Colorado Springs Gazette Obituary and Memorial Gazdens <br />Cemetery records (Exhibit 58). Thus, Allen could not have provided notice to either N.C. or <br />Lora Cazgill. <br />b. Robert Cargill is not an owner of record to whom Allen should have given <br />notice. <br />N.C. Cazgill's son, Robert Cazgill, is not an Owner of Record of the subject property. <br />Rule 1.1(34) defines "Owner of Record" as "the owner or owners of a surface property interest <br />shown on the records of the County Assessor as of the date of filing" (emphasis addedj. The <br />records of the County Assessor do not show Robert Cazgill as an owner of any interest-either <br />surface or subsurface-in the subject property. See Park County Assessor's Property Detail and <br />Assessment Information for the Subject Property (Exhibit 75). Furthermore, and as the <br />Objectors themselves have shown, no[ even the records of the Park County Clerk and Recorder <br />
