7. Allen Has The Legal Right To Enter The Subject Property And Conduct Mining <br />And Reclamation Activities. <br />a. Allen has established its legal right to enter in conformance with Rules 6.4.14 <br />and 6.3.7. <br />The Objectors allege incorrectly that Allen's application is incomplete for failing to <br />comply with the requirement to submit a description of Allen's basis for the right to enter the site <br />and conduct mining and reclamation. Allen has fully satisfied the applicable requirements. <br />Rules 6.3.7 and 6.4.14 require Allen to "[p]rovide a description of the basis for legal right of <br />entry to the site and to conduct mining and reclamation ... [a] signed statement by the <br />Landowner and acknowledged by a Notary Public stating that the Operator/Applicant has legal <br />right to enter and mine is also acceptable." Rule 6.3.7. Exhibit N to Allen's permit application <br />is titled "Source of Legal Right to Enter," and consists of a signed statement of the landowners, <br />Jack and Susanne Allen, acknowledged by a Notary Public, stating that Allen has the legal right <br />to enter the property and conduct mining operations. Additionally, Exhibit O to Allen's <br />application contains the Warranty Deed of Jack and Susanne Allen for the property upon which <br />Allen's mining operations will be conducted. By the cleaz terms of the Rules, Allen has fully <br />complied with the requirement to provide a description for the basis of its legal right to enter the <br />property and conduct sand and gravel mining and reclamation. Moreover, at the pre-hearing <br />conference on June 15, the Objectors' counsel unequivocally admitted that Allen had satisfied <br />this requirement. <br />b. The question of the ownership of any potential mineral rights is not properly <br />before the Board. <br />Neither [he Rules nor the Colorado Land Reclamation Act for the Extraction of <br />Construction Materials, C.R.S. § 34-32.5-101 e[ seq.
