t <br />EXHIBIT D III ~IIIIIIIIIIIIIII <br />MINING PLAN AND TIMETABLE <br />History; <br />Clay has been mined continuously at the Ute Mine since it <br /> <br /> <br /> <br />was originally leased by Robco in 1954. There have been two <br />owners since the original lease was obtained from Alfred Nitz. <br />This chain of events has been chronicled below by Chick Thorne <br />from records in Che files of Robinson Brick and Tile Company <br />so that the hILRB will better understand some of the antagonism <br />that has occurred before the Board in past hearings regarding <br />this mine, <br />A Clay Lease Agreement was executed between The <br />Robinson Brick and Tile Company and Alfred Nitz, September <br />29, 1954. The lease was for a period of twelve (12) years <br />from the date first written and for so long thereafter as <br />clay or earth produced or removed from the above described <br />land or mining operations are conducted. No termination <br />or cancellation of lease could occur as long as there was <br />no cessation or interruption of mining operations for a <br />period of time in excess of six (6) consecutive months, <br />An annual rental fee and a royalty fee for each cubic <br />yard of clay removed was also included in the lease. <br />Lessee was given rights-of-way over Lessor's land <br />as was necessary and convenient for removal and transpor- <br />tation of clay. <br /> <br /> <br />- 5 - <br />
