Long <br />Division Director <br />RE: File No. M-99-005, All Rite Paving and Redi 1Viix, North River Pit, Letter from Burlington <br />Northern Santa Fe Railwav and Exhibit S <br />Deaz Mr. Gesso and Mr. Laird: <br />On Apnl 12, 1999, the Division received the attached letter from Burlington Northem Santa Fe Railway. <br />In regard to Exhibit S of the application, the letter satisfies any ccncems that the company may have <br />about the. portion of the proposed mining operation north of the Arkansas River but, it does not address <br />Exhibit S as it relates to the proposed portion of the mining operation south of the Arkansas River near the <br />company's tracks and right-of-way. <br />Please provide an agreement between the Railroad Company and.Ali Ri+e. Pavi;tig and Redi: Mix regazding <br />any damage to the Kailroad Coompany's structure(s) within 200 feet of proposed affected land or provide <br />an engineering evaluation demonstrating that such structure(s) wiil nor be datrtagerl Icy activities occurring <br />at the mining operation.
